These Terms of Service are the agreement between you and Tango Down Tactical LLC (“we,” “us,” or “our”) for use of tangodowntactical.com and for purchases, firearm transfers, and training you arrange with us. By using the site, submitting a form, or placing an order, you agree to these Terms, our Privacy Policy, and our Return Policy.
1. The business
We are a Type 07 federal firearms licensee and SOT 2 in Kinston, North Carolina. We offer firearms training, inbound firearm transfers, custom builds, and, when the online shop is open, factory firearms, ammunition, and accessories. Some merchandise is drop-shipped by our distributors. We remain the seller on those orders.
Our premises are open only during the posted hours. Transfers and builds are by appointment. Our range is for scheduled classes only. It is not open to the public and is not for rent.
2. Eligibility
You must be at least 18 to use this site. You must also meet every federal, state, and local requirement that applies to the product or service you want. In general, federal law requires a person to be 18 to receive a rifle or shotgun and 21 to receive a handgun or other firearm from a licensed dealer. Stricter state or local rules control when they apply.
You agree that you may lawfully possess the firearm or ammunition where you live and where you take possession. The age question on this site is not a background check, a Form 4473, or proof that you are eligible.
We do not sell to anyone who is prohibited from receiving a firearm, and we may refuse any order or transfer that we believe would violate the law or our dealer obligations.
3. Orders
A listing on this site is an invitation to order, not a promise that the item is in stock. Drop-shipped inventory, photos, and descriptions can change without notice. We may limit quantities.
We accept an order only when we send a confirmation or charge your payment method, whichever happens first. We may cancel an order if the item is unavailable, the price was posted in error, the sale would violate the law, the receiving dealer will not accept the shipment, a background check is denied, or you do not complete pickup. If we cancel before an item ships, we will refund the amount you paid us for that item.
Prices on minimum-advertised-price items will not be displayed below the manufacturer’s floor. A price does not include transfer fees, shipping, or taxes unless the checkout says it does.
4. Firearms and transfers
Serialized firearms, frames, and receivers ship only to a licensed dealer. We do not ship firearms to a house, apartment, or other residence. Completing checkout is not approval to possess a firearm and is not a background check.
Before you take possession, the receiving dealer will have you complete ATF Form 4473 and a National Instant Criminal Background Check System (NICS) check, or the state point-of-contact check required by law. You must pass that check and pick up the firearm in person with valid identification.
If we are the receiving dealer for a firearm you bought from someone else, our transfer fee is $35 per firearm unless we agree otherwise in writing. That fee covers receiving the firearm and processing the transfer. It is not a deposit on the gun and it is not refunded if the background check is denied or you do not complete pickup, unless we caused the problem.
If a background check is denied, we cannot transfer the firearm to you. The firearm goes back to the selling dealer under that seller’s instructions. Return freight and any restocking charge are your cost unless the seller agrees otherwise.
You are responsible for giving us a correct receiving dealer. If that dealer refuses the package or is not licensed to receive it, you are responsible for the resulting freight, restocking, and cancellation costs.
5. Ammunition and accessories
Accessories that are not firearms may ship to an address where that shipment is legal. You are responsible for the laws at the destination.
We ship ammunition only where it is legal to do so. Adult signature may be required. We may cancel an ammunition order that we cannot lawfully ship.
6. NFA items
Suppressors and other National Firearms Act items are transferred only through the process required by ATF, including any tax stamp or electronic form and the required wait. We do not mail an NFA item to a residence. An NFA item is final once the transfer paperwork is submitted, except as stated in the Return Policy. ATF processing times are not ours to control.
7. Custom builds
A custom rifle or pistol is built to the specification we confirm with you. Work that has started is not returnable because you changed your mind. Our limited lifetime warranty covers our assembly, as described on the Warranty page. It does not cover misuse, unauthorized alteration, or remanufactured ammunition. Factory parts stay under the manufacturer’s warranty.
8. Training
Class dates, prices, and seats are those published for that course, including any USCCA registration page we link to. You must meet the course prerequisites and follow the range rules and waiver for that class. We may remove anyone who is unsafe. Training is instruction. It is not a promise of any particular shooting result, permit approval, or legal outcome. Permit eligibility is decided by the issuing authority, not by us.
9. Payment
In-person payments are processed by our merchant provider. When online checkout is open, card data is entered with that provider’s gateway. We do not store full card numbers on this site. You authorize us to charge the payment method you submit for the order, the transfer fee, and any approved shipping or tax.
If a charge is reversed or a payment fails after we have ordered a drop-shipped item, you still owe the amount of the order, and we may cancel it and recover our costs.
10. Shipping, returns, and refunds
Delivery dates are estimates. A carrier delay is not a reason, by itself, to cancel a firearm that has already shipped to a dealer.
Returns and refunds are governed by our Return Policy. Email returns@tangodowntactical.com before you send anything back. Do not ship an item to us or to a distributor until we reply.
11. Your conduct on the site
You will not use the site to break the law, to buy a firearm for a person who is prohibited from receiving it, to interfere with the site, to scrape it in a way that degrades service, or to submit false information on a form, an order, or a Form 4473. We may refuse service, cancel an order, or block access if you do.
12. Intellectual property
The site design, our name, and our logo are ours or are used with permission. Product names and photos may belong to the manufacturers. You may not copy the site for a commercial use without our written permission.
13. Disclaimer and limit of liability
Firearms, ammunition, and range activity are inherently dangerous. You are responsible for safe handling, storage, and use, and for following the law. Training reduces risk only if you apply it. It does not remove risk.
Except where the law does not allow a disclaimer, the site and the goods and services are provided as available. We do not warrant that the site will be uninterrupted or error-free. To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, or for lost profits. Our total liability for a claim about a product or service is limited to the amount you paid us for that product or service.
Nothing in these Terms limits liability that cannot be limited under North Carolina law, including liability for our own gross negligence or willful misconduct where a limit would be unenforceable.
14. Privacy
Our Privacy Policy describes what we collect and how we use it. Firearm-transfer records, including Form 4473, are kept for the period required by ATF and state law. Those records are not deleted because of a website request.
15. Changes
We may update these Terms by posting a new version on this page and changing the “Last updated” date. The version posted when you place an order applies to that order. Continued use of the site after we post a change means you accept the updated Terms for later use.
16. Governing law
These Terms are governed by the laws of the State of North Carolina and by applicable federal firearms law, without regard to conflict-of-law rules. You agree that the state courts located in North Carolina, and the federal courts sitting there, are the place for a dispute arising out of these Terms or the site, except where a law that cannot be waived requires another forum.
